Welcome to Teacher Comment Generator. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Teacher Comment Generator ("we," "us," or "our").

Teacher Comment Generator is an AI-powered platform that helps educators create personalized, professional report card comments. Our service uses artificial intelligence (Anthropic Claude) to generate comments based on student information you provide.

We reserve the right to modify, suspend, or discontinue any part of our service at any time with or without notice.

3. Eligibility

To use our service, you must:

• Be at least 18 years of age
• Be a teacher, educator, or school administrator with legitimate educational interests
• Have the legal authority to enter into this agreement
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

4. User Accounts

4.1 Account Creation

You must create an account to use our service. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

5. Usage Plans and Limits

5.1 Free Plan

• 10 comment generations per month
• Access to all comment types and features (unless specified as Pro-only)
• Usage resets on the first day of each calendar month

5.2 Pro Plan (Coming Soon)

We plan to offer a Pro subscription with:

• Unlimited comment generations
• Bulk CSV upload and generation
• Export to Word/PDF formats
• Priority support

Pricing and terms for Pro plans will be communicated prior to launch. We reserve the right to modify pricing at any time with 30 days notice to existing subscribers.

6. Acceptable Use Policy

You agree NOT to:

• Misuse the Service: Use the service for any illegal, harmful, or fraudulent purpose
• Abuse or Circumvent: Attempt to bypass usage limits, security measures, or rate limiting
• Share Accounts: Share your account credentials with others or allow unauthorized access
• Scrape or Automate: Use bots, scrapers, or automated tools to access the service
• Reverse Engineer: Attempt to reverse engineer, decompile, or extract source code
• Interfere: Interfere with or disrupt the service or servers
• Resell: Resell, sublicense, or redistribute the service without permission
• Impersonate: Impersonate any person or entity
• Violate Laws: Use the service in violation of any applicable laws or regulations
• Harmful Content: Generate comments containing discriminatory, offensive, or inappropriate content

Violation of this Acceptable Use Policy may result in immediate termination of your account.

7. AI-Generated Content

7.1 Nature of AI Content

Our service uses artificial intelligence (AI) to generate report card comments. You acknowledge and agree that:

• AI-generated content is created algorithmically and may contain errors, inaccuracies, or inappropriate language
• You are solely responsible for reviewing, editing, and approving all AI-generated comments before use
• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content
• AI-generated comments are suggestions only and should be reviewed by a qualified educator

7.2 Your Responsibility

IMPORTANT: You are responsible for ensuring that all comments you use are:

• Accurate and appropriate for the student
• Compliant with your school's policies and standards
• Free from discriminatory, biased, or offensive language
• Reviewed and approved by you before being submitted to parents or students

We are not liable for any consequences arising from your use of AI-generated comments.

8. Intellectual Property

8.1 Our Intellectual Property

The service, including its original content, features, functionality, software, design, and trademarks, is owned by us and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Content and Data

You retain all rights to the data you input into our service (student information, notes, etc.). By using our service, you grant us a limited license to:

• Process your data to provide the service (e.g., send to AI for comment generation)
• Store your data securely on our servers
• Use aggregated, anonymized data for service improvement and analytics

8.3 Generated Comments

You own the AI-generated comments created through our service. You are free to use, modify, and distribute these comments as you see fit. However, you may not claim that we endorse or are responsible for your use of the comments.

9. Privacy and Data Protection

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

By using our service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 No Warranties

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Damages arising from your use of AI-generated comments
• Damages resulting from unauthorized access to your account
• Any claim exceeding the amount you paid us in the past 12 months (or $100, whichever is greater)

10.3 Educational Disclaimer

We are not responsible for: Any educational decisions, student outcomes, parent reactions, or school policy violations arising from your use of generated comments. You are a trained professional and must exercise your own judgment.

11. Indemnification

You agree to indemnify, defend, and hold harmless Teacher Comment Generator, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your use of AI-generated comments
• Your violation of any third-party rights
• Any content you submit to the service

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through settings (when available)

12.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• Your account is inactive for more than 12 months

• We decide to discontinue the service

12.3 Effect of Termination

Upon termination:

• Your right to use the service immediately ceases
• Your data will be deleted within 30 days (unless required by law to retain)
• You remain liable for any outstanding obligations
• Sections that by their nature should survive termination will survive (e.g., disclaimers, limitation of liability)

• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the service after changes are posted constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the service and may request account deletion.
